Welcome to TextBehind! These Terms of Service ("Terms") govern your use of the TextBehind application and services (collectively, the "Service"). Please read these Terms carefully before using the Service. By accessing or using the Service, you agree to be bound by these Terms.

1. Use of Service

TextBehind grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or internal business purposes, subject to these Terms.

You agree not to use the Service for any unlawful purpose or in any way that interrupts, damages, impairs, or renders the Service less efficient. You agree not to attempt any unauthorized access to any part or component of the Service.

2. Privacy and Data

Your privacy is important to us. Our Privacy Policy, available at /privacy-policy, explains how we handle your information. As detailed in the Privacy Policy, the core functionality of TextBehind processes images locally on your device. We do not upload or store your images on our servers. Account and payment information is handled as described in the Privacy Policy.

3. Accounts and Payments

Certain features of the Service may require you to create an account or make a purchase. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to provide accurate and complete information when creating an account or making a purchase. Payments are processed through our third-party payment processor, Polar, subject to their terms and conditions.

4. Refund Policy

We offer refunds under certain conditions as outlined in our separate Refund Policy. Please review our Refund Policy for detailed information on eligibility and how to request a refund.

5. Intellectual Property

The Service and its original content (excluding content provided by users, such as their images), features, and functionality are and will remain the exclusive property of TextBehind and its licensors. The Service is protected by copyright and other laws. Our branding may not be used in connection with any product or service without the prior written consent of TextBehind.

6. User Content

You retain full ownership of the images and content you process using TextBehind ("User Content"). By using the Service, you grantTextBehind no rights or licenses to your User Content, as it remains on your local device. You are solely responsible for your User Content and the consequences of processing and using it.

7. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis.TextBehind makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

9. Limitation of Liability

In no event shall TextBehind, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein (related to account/payment data); (iii) any interruption or cessation of transmission to or from the Service; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our service by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service; and/or (vi) the defamatory, offensive, or illegal conduct of any third party.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which TextBehind operates, without regard to its conflict of law provisions. We will specify the exact jurisdiction in future updates to these terms.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
